Being charged with a DUI or criminal offense is not the end of the world. You may be eligible for a diversion.
A diversionary agreement is a contract. My client must comply with a number of terms and conditions, and if he/she does so, along with remaining a law-abiding citizen for a year, then the DUI or criminal charge against them is dismissed. The theory is that everyone is entitled to one screw up. The good thing about a diversion is that it is not a conviction. Therefore, you can fill out job applications, rental applications, etc. and state that you have never been convicted of a crime. The best thing about a DUI diversion is that you DO NOT
have to serve the mandatory jail time. A diversion will also prevent your Driver’s License from being suspended for a DUI conviction. The bad thing about diversion is that if you are unlucky enough to get a second DUI, then the diversion will count as if it was a conviction. You will then be charged with a DUI 2nd Offense.
